Finances on Divorce

Dealing with finances on divorce can be contentious.

Our team will help you try to resolve matters pragmatically, to preserve your interests and that of your family.

We strongly recommend all parties receive independent advice regarding their financial entitlements on divorce. In many cases following this advice you and your spouse may be able to agree the terms of financial settlement, without issuing court proceedings. There are also other options, including arbitration, mediation, round table negotiations and collaborative law available to you.

If you have agreed the terms of settlement with your spouse they can be embodied in a document called a “Consent Order”, which once agreed by you and your spouse (ideally with the benefit of legal advice) is sent to the court for a Judge to approve. Thereafter, it is a legally binding document upon which both parties can rely to provide certainty for the future and prevent future financial claims.

In the event you are unable to agree the financial matters with your spouse you can make an application to the court to seek a Financial Remedies Order.

A financial application to court may be necessary if:

  • matters cannot be agreed
  • there is concern regarding dissipation of assets
  • one party may be concealing assets
  • there is a significant dispute regarding the value of assets and needs
