Child Law

When children are faced with immediate danger, emergency remedies may be required to safeguard their welfare until more permanent decisions for their care can be made.

Sometimes, the police may choose to use their powers of protection to take children away from a home environment that they feel is unsafe. Sometimes a social worker may apply to the court for an order known as an Emergency Protection Order (or EPO) to remove children temporarily. Court hearings are often started at very short notice.

Both emergency remedies are temporary arrangements designed to keep children safe while investigations and assessments can be carried out to identify what is in the child’s best interests. This could lead to the issuing of care proceedings or it could result in children being returned home.
