Lasting Power of Attorney
If you were to become incapacitated, your family will find comfort in knowing that you have appointed someone to make decisions for you in the event you are unable to make those decisions yourself.
We can assist you in creating Lasting Power of Attorney (LPA) for property and finance matters as well as to make health and welfare decisions.
How we can help
We will discuss your requirements with you to establish:
- How many Attorneys you wish to appoint and who to appoint
- How your Attorneys are to act (Jointly or Jointly and Severally)
- Whether you wish to include Restrictions or Conditions or to express Preferences and if so how these should be worded
- Whether you wish to nominate someone to be notified when the Powers are registered with the Office of the Public Guardian (“OPG”)
- Who will act as a Certificate Provider (we can take this role for you if required)
- Whether the Powers(s) should be registered with the OPG straight away or whether there may be circumstances when it would be better to defer registration
What’s involved
Once we have established your requirements we will prepare draft documents for you to check and then arrange for them to be signed by all parties – Donors; Certificate Provider and Attorneys. We will then deal with the registration of the Powers at the OPG and provide you with certified copies of the documents if required once registration has been completed. We offer a free storage service for all Powers of Attorney that we prepare.
The preparation of Lasting Power of Attorney is dealt with on a Fixed Fee basis so you know at the outset exactly what the costs will be.
We can also arrange home visits for a small additional cost if you are unable to attend the office.
In addition
It is sometimes necessary for Powers of Attorney to be revoked or changed after they have been completed and registered with the OPG. We can make all the necessary arrangements to ensure your Powers of Attorney are up to date and in accordance with your wishes.
Court of Protection
If you or someone you are close to becomes incapacitated without having made a Power of Attorney, it is likely that it will be necessary for an application to be made to the Court of Protection to be appointed a Deputy. Your claim must be made within three years of the date of the accident (or with industrial diseases claims, three years from the date of knowledge of the disease).
