What is Probate? Probate is the legal process of handling the estate of someone who has died. It involves distributing assets, paying off debts, and ensuring all legal and tax obligations are fulfilled.
Step-by-Step Probate Process
- Registering the Death: The first step is to register the death at the local register office and obtain a death certificate. The online ‘Tell Us Once’ process should also be completed, to notify all government departments of the death.
- Locating the Will: Find the will. If no will is present, the estate is handled under intestacy rules.
- Appointing an Executor or Administrator: If there’s a will, the executor manages the estate. Without a will, the next of kin will be the administrator.
- Valuing the Estate: The estate’s value, including assets like property and savings, is calculated, and debts are deducted.
- Applying for Probate: The executor or administrator applies for a Grant of Probate or Letters of Administration by submitting forms to the Probate Registry. This can easily be done online on the Government website.
- Paying Inheritance Tax: If the estate exceeds the inheritance tax threshold, tax must be paid, often before probate is granted.
- Settling Debts and Distributing the Estate: Debts are settled first, followed by the distribution of remaining assets to the beneficiaries.
- Finalising the Estate: The executor then closes the estate, ensuring all financial obligations are met and assets distributed according to the Will or the intestacy rules.
- New Will: Those who are beneficiaries under the deceased’s Will may want to consider either making or updating their existing Wills to reflect their inheritance.
