Liability was not straightforward in this claim. The Client, who is a Social Worker tripped over a defect in a pavement and sustained a ruptured hamstring which resulted in her being off work for a significant amount of time.
At the time of the incident, visibility was poor, it was dark and there were no warning signs regarding the pavement defect. The Client’s previous solicitors had advised that the claim had no prospects of success as the accident had not been reported directly after it occurred. They stated that there was no evidence of the accident taking place and that even if it would be proven that the accident did take place, the Court was likely to find that it was unforeseeable, and the Defendant was not negligent. Following Hatch Brenner’s initial contact with the Defendant’s representatives, liability was admitted immediately.
Hatch Brenner’s personal injury specialist was able to recover £4,000 for the client. Upon the successful conclusion of her claim, the Client commented that Pasha and Hatch Brenner had been “brilliant” and that they “believed in her case whereas her previous solicitors did not”, and that she “would always come back to Hatch Brenner”.
